You must be at least 18 years old to use our services. We may update these terms as needed for new or modified services, and we’ll give you at least 30 days’ notice via email or our website. Continued use after updates means you accept the changes.
Your Account
You’re responsible for all activity and charges on your account. If there’s a violation of these terms or illegal activity, we may need to suspend or terminate your service. We’ll try to notify you first, unless it’s an urgent legal or operational issue. For minor issues, we’ll work with you to resolve them before taking action. If we terminate your account, we typically don’t offer refunds for partial months, but we’ll consider pro-rated refunds for unused portions of annual plans on a case-by-case basis.
Billing
We may adjust fees or billing methods, but we’ll give you 30 days’ notice. You’re responsible for paying all reasonable charges, like service fees, taxes, and anything listed in our current fee schedule.
Most services are billed periodically—monthly plans in advance each month, and annual plans in advance each year. For accounts with anniversary dates of 29th, 30th, or 31st, billing shifts to the last day of shorter months. If you pay by credit card for an annual plan, we’ll charge you automatically on your anniversary date.
Please keep your email address current in our billing system to get timely notices. We’ll make reasonable efforts to reach you, but we’re not responsible for missed notices if your contact info is outdated. If payment is more than 30 days late, we may add a late fee of $5 or 1.5% of the balance (whichever is greater) and could deactivate your account. After a 5-day grace period, we may suspend or terminate overdue accounts at our discretion.
Cancelling Your Service
You or Optimus Media can end this agreement at any time. If you’re unhappy, cancelling is your main way to resolve disputes, though we’d love to address your concerns through customer support first. To cancel, contact us via 731-412-0766, our website portal, or certified mail. Email cancellations aren’t accepted to ensure we process your request correctly.
Setup fees aren’t refundable, but if you’re on an annual hosting plan, you can request a pro-rated refund within 120 days of account creation. After that, refunds for unused time aren’t guaranteed but may be considered.
How to Use Our Services
We want our services to be a safe and respectful space. You can’t use them for illegal activities, copyright infringement, harassment, or excessive unsolicited communications. For example, sending more than 50 unsolicited emails per hour counts as bulk mailing and could lead to suspension. If there’s a problem, we’ll usually warn you first, but serious violations (like hacking attempts) may result in immediate action. We’ll notify you when possible, and violations could lead to deactivation or termination, depending on severity.
Your Content
You’re free to use our services for private or business purposes, but we may need to step in if content crosses the line. We can remove anything illegal, infringing on copyrights, or promoting extreme violence or hate, based on applicable laws and our reasonable judgment. We’ll let you know if we remove something, unless it’s an urgent legal or safety issue. You’re in charge of your content—we’re just here to keep things running smoothly.
Our Services
We strive to deliver top-notch service, but the internet isn’t perfect, and occasional outages happen. We’ll do our best to minimize downtime and get things back online quickly. Brief interruptions aren’t grounds for refunds, but if an outage lasts more than 12 hours, we’ll consider credits at our discretion. We may also tweak or update services to better serve you, with 30 days’ notice when possible.
Our Promises
We aim to provide professional, industry-standard services in a timely manner, following all applicable telecom laws and regulations. That said, we’re not responsible for installing, operating, or maintaining equipment or software you bring to the table—only what we provide.
What We Can’t Guarantee
Our services are offered “as is” and “as available.” We can’t promise they’ll always be error-free or that third-party content on the internet (like websites you visit) is safe or reliable. You’re responsible for evaluating the accuracy and quality of anything you find online outside our control. We don’t warrant that the internet or our network will be free of viruses or glitches, but we’ll use our best efforts to restore service if something goes wrong.
We’re not liable for damages from your use (or inability to use) our services, reliance on online info, or issues like data loss or delays—unless it’s our direct fault. Our liability is capped at the fees you’ve paid us, except where law says otherwise. No advice from us or our team creates extra warranties.
